Terms of Service

These Terms of Service (“Terms”) govern your use of HEWA, the AI IDE for builders everywhere (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & availability

You must be at least 18 years old to use the Service. The Service is currently offered in Kenya, Rwanda, Ethiopia, Uganda, Somalia, Nigeria, Zambia, and Tanzania. We may add or remove regions over time.

2. Your account

You are responsible for activity under your account and for keeping your credentials secure. Provide accurate information and notify us promptly of any unauthorised use. You may sign in using email, GitHub, or Google.

3. Credits & payments

  • You top up credits via M-Pesa from approximately 12 KES per credit (minimum 35 credits per top-up). Prices are indicative and may change.
  • Your first prompt is free to try. Your first credit top-up earns a one-time bonus of 50 credits.
  • We may offer promotional credits from time to time (for example a bonus on a top-up, or a promo code). Each promotion's specific terms — eligibility, amount, and validity period — apply, and we may change, suspend, or end any promotion at any time. Promotional credits have no cash value and are non-refundable.
  • There is no subscription — you pay only for what you use.
  • Credits are consumed as you use AI features. Except where required by applicable law, purchased credits are non-refundable and have no cash value.

4. Acceptable use

You agree not to use the Service to:

  • break the law or infringe others’ rights (including intellectual-property rights);
  • build or distribute malware, conduct attacks, or attempt to disrupt or reverse-engineer the Service;
  • generate content that is unlawful, harmful, or abusive;
  • resell or abuse the Service, or circumvent usage, security, or rate limits.

5. Your content & intellectual property

You own the code and content you create with HEWA. You grant us a limited licence to host, process, and transmit your content solely to operate and improve the Service (including sending prompts and context to AI providers to fulfil your requests). HEWA’s own software, brand, and site remain our property.

6. AI output

AI-generated code and suggestions may be inaccurate, insecure, or incomplete. You are responsible for reviewing, testing, and deciding whether to use any output. HEWA does not warrant that generated content is correct, fit for a particular purpose, or free of third-party rights.

7. Service availability & changes

HEWA is evolving and provided on an “as available” basis. We may add, change, or discontinue features, and we may perform maintenance that temporarily affects availability. We aim to give reasonable notice of material changes.

8. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, HEWA will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the three months before the claim or the local-currency equivalent of US$50. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive termination will survive.

11. Indemnity

You agree to indemnify HEWA against claims arising from your content or your misuse of the Service or violation of these Terms, except to the extent caused by us.

12. Governing law & disputes

These Terms are governed by the laws of Kenya. The courts of Kenya shall have exclusive jurisdiction over any dispute, subject to any mandatory rights available to you under the laws of the country where you reside.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date; your continued use after changes take effect constitutes acceptance.
